B 69 Latin. 11 November 1342. Dated at Neubigg. die lune in festo Sancti Martini in hieme anno Domini millesimo tricentesimo quadragesimo secundo. Indenture witnessing that whereas William de Acton, of Newcastle-upon-Tyne, senior, has confirmed to Adam de Acton and Agnes, daughter of Thomas Fossour de Thokeryntone, 5 marks yearly arising out of lands of William in Neubiggin near Wodhorne, Adam and Agnes grant that if William or heirs within 3 years shall have enfeoffed Adam and Agnes in 40s. worth of rent yearly arising from lands in Newcastle, the deed concerning the five marks of rent shall be void; saving that if Adam and Agnes be not enfeoffed of the 40s. worth of rent within 3 years the deed concerning the 5 marks shall stand.
