Will of John Howdon of Walkerfield 8 July 1842 – devising (a) all his property at South Street, Durham, to his daughter Jane, widow of John Barnes, where she lived; – devising the residue of his real estate to his son William Watson Howdon, nephew William Hunt of Dilstone (Northumberland), gentleman, son-in-law Richard Barnes and daughter Jane in trust: (b) closes in Ingleton purchased from John Allan, esquire and in occupation of Ralph Musgrave in trust for Elizabeth Mary Yates and Fanny Anna Yates, daughters of testator’s daughter Mary Yates, deceased as tenants in common, remainder, if both died under 21, to testator’s daughters Jane Barnes and Frances, wife of Richard Barnes for ever as tenants in common; while Elizabeth Mary and Fanny Anna were under 21 the trustees taking rents and profits and applying them to their maintenance; (c) real estate in Houghton le Side in Gainford and Leeside in Hilton in trust for sale, the proceeds as well as debts owed to the testator to be used to pay his debts, the excess to be invested at interest; if the sale of the lands at Houghton le Side and Leeside was insufficient to pay his debts then power for the trustees to mortgage; in the lifetime of testator’s wife Elizabeth to pay to his son Christopher an annuity of £20 from rents and profits of the property in Houghton le Side and Leeside with excess rents and profits paid to Elizabeth for her life; – trustees to pay £600 legacies to Jane Barnes, to testator’s daughter Elizabeth, wife of Francis Davison and to Frances Barnes; – legacies of £20 to each trustee; – trustees to deduct from the £600 to be paid to Frances Barnes any sums they may have to pay as surety for Richard Barnes; – trustees to invest a quarter of the residue of the testator’s personal estate and pay interest to testator’s son Christopher, remainder to pay interest to his daughters Anne and Agnes during their minorities then divide the principal between them; – trustees to pay three-quarters of the residue of the testator’s personal estate to his sons William Watson Howdon, John Hawdon and Joseph Hawdon equally; – bequeathing all household furniture, plate, linen, china, books and pictures to his wife along with all cash in the house; – bequeathing to his son William Watson Howdon his cow, horse and phaeton; – devising to William Watson Hawdon, William Hunt, Richard Barnes and Jane Barnes all real estate for which he was trustee; – appointing William Watson Hawdon, William Hut, Richard Barnes and Jane Barnes as executors; – witnesses: M.
